Once we have agreed on the direction for your wedding or project, Artificielle will provide a Booking Summary setting out the agreed scope, inclusions and investment.
Your booking is confirmed when you accept the Booking Summary and these Terms & Conditions and the 50% booking payment has been received. Your acceptance forms our agreement. Dates are not secured until both acceptance and payment have been received.
If the scope later changes, Artificielle will provide an updated Booking Summary so that the current agreed details are recorded clearly.
A 50% booking payment is required to confirm your date. The remaining 50% is due one month before the wedding or project date, unless a different arrangement is recorded in writing.
The booking payment secures your date and allows planning, design development and preparation to begin. If the final payment becomes overdue, please contact Artificielle promptly. Preparation or installation may be paused until the account is brought up to date.
Artificielle is engaged for its creative direction and design style. Reference images, mood boards and collection imagery are used to communicate direction rather than to promise an exact copy.
Florals, foliage and decor may be adjusted or substituted where necessary to achieve the agreed overall aesthetic, respond to the venue, maintain quality or accommodate availability. Any material change to the agreed scope will be discussed with you.
Changes requested after confirmation are subject to availability, timing and the practical requirements of the design. Additional work, florals, decor, travel, labour or logistics may result in an updated price.
Significant reductions to the agreed scope close to the event may not result in an equivalent reduction in the amount payable where design, preparation, reserved inventory or other work has already been committed.
Unless expressly stated otherwise, Artificielle florals, vessels, structures, signage, styling pieces and decor remain the property of Artificielle Floral Co. They are supplied for the agreed event or project only and are not transferred to the client.
The client is responsible for taking reasonable care of hired items while they are at the venue or otherwise under the client's control. The reasonable cost of repair or replacement may be charged where an item is lost, removed or damaged beyond ordinary wear through misuse, negligence or unauthorised handling.
The client is responsible for providing accurate venue details and ensuring Artificielle has the access reasonably required for delivery, installation, repurposing and collection at the agreed times.
Venue rules, access restrictions, loading requirements, installation limitations and pack-down deadlines should be disclosed as early as possible. Additional labour, waiting time, travel or equipment required because of undisclosed or changed venue conditions may incur an additional charge.
Any hanging, structural or specialist installation is subject to venue approval and to Artificielle being satisfied that it can be installed safely and appropriately.
Moving ceremony florals or decor to a reception is a planned service and is only included where stated in the agreed scope. It depends on access, distance, timing, staffing and the suitability of the pieces to be moved.
Where circumstances on the day make a planned move unsafe or impractical, Artificielle may adapt the placement in consultation with the client, venue or nominated contact where reasonably possible.
Outdoor installations are affected by weather and site conditions. Artificielle may alter, relocate, reduce or decline an installation where wind, rain, heat, ground conditions or another hazard makes the original plan unsafe or unsuitable.
Where possible, an alternative will be discussed. Decisions concerning safety and protection of people, property and hired items may need to be made on the day.
Artificielle works alongside venues and other suppliers but is not responsible for the acts, omissions, delays, products or services of independent third parties.
If another supplier needs to move, attach to, light, photograph around or otherwise interact with an Artificielle installation, reasonable care must be taken and any relevant requirements should be discussed in advance.
If you need to cancel or postpone, please notify Artificielle in writing as soon as possible. Any amount retained or payable following cancellation will take into account the timing of the cancellation, design and preparation already completed, costs already committed and losses reasonably incurred as a result of the cancellation, subject always to rights that apply under New Zealand law.
Where a postponement can reasonably be accommodated, payments may be transferred to a new available date. An updated Booking Summary will be issued where the date, scope, pricing, travel or other requirements change.
If circumstances outside either party's reasonable control materially affect the event or Artificielle's ability to perform the agreed services, both parties will communicate promptly and work in good faith toward a practical solution where possible.
This may include adapting the design, timing, location or services, postponing the work, or addressing cancellation in accordance with these Terms & Conditions and applicable New Zealand law.
Artificielle may photograph or record its own work during preparation, installation or the completed event and may use imagery of its designs for its portfolio, website, social media, editorial submissions and marketing, subject to any privacy or content arrangements agreed with the client.
Where professional photographs are supplied or shared, appropriate photographer and vendor credits will be respected where known. Client privacy requests should be raised before the event so they can be agreed clearly.
Creative collaborations and set builds may involve different deliverables, usage arrangements, credits, access times, content expectations and third-party participants. These will be recorded in the relevant Booking Summary or other written project confirmation.
Unless agreed otherwise in writing, Artificielle retains ownership of its original concepts, designs and hire property. Permission to photograph a set or installation does not transfer ownership of Artificielle's underlying design or other intellectual property.
Nothing in these terms is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under New Zealand law, including rights that may apply under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
If something isn't right, please contact Artificielle as soon as possible so there is an opportunity to understand the issue and work toward a resolution.
These terms are governed by New Zealand law. Nothing in this section prevents either party from using any dispute-resolution process or remedy available to them by law.
